INSUREIF TERMS OF SERVICE

1. AGREEMENT TO THESE TERMS
These Terms of Service (“Terms”) govern access to and use of the InsureIF website, applications, accounts, communications, products, services, and related features collectively referred to as the “Platform.”
The Platform is operated by InsureIF LLC (“InsureIF,” “we,” “us,” or “our”).
By creating an account, clicking to accept these Terms, purchasing a product or service, publishing information through the Platform, or otherwise accessing or using the Platform, you agree to be bound by:
• These Terms;
• The InsureIF Privacy Policy;
• Any plan, transaction, campaign, referral, quote, or product-specific terms presented to you; and
• Applicable laws and regulations.
If you do not agree to these Terms, you may not access or use the Platform.
If you use the Platform on behalf of an agency, business, employer, organization, or other legal entity, you represent that you have authority to bind that entity. In that circumstance, “you” includes both you and the entity.
2. DEFINITIONS
For purposes of these Terms:
“Agent” means an insurance agent, producer, agency, or authorized representative who accesses or uses the Platform for insurance-related business purposes.
“Consumer” means an individual who creates an account, uploads or enters insurance information, publishes a Lead, receives quotes, participates in a campaign, or otherwise uses the Platform in a personal or household capacity.
“Campaign” means a program, promotion, referral arrangement, incentive, educational initiative, employer program, or other activity created, sponsored, or administered through the Platform.
“Campaign Sponsor” means an Agent, vendor, employer, organization, or other person responsible for creating, funding, offering, or fulfilling a Campaign.
“Lead” means an insurance opportunity, profile, record, request, or collection of information made available through the Platform for review or quoting by eligible Agents.
“Membership” means a paid subscription, recurring plan, service level, or package offered through the Platform.
“Quote” means an insurance premium indication, proposal, estimate, comparison, or offer submitted or displayed through the Platform.
“Qualifying Quote” means a Quote that satisfies the Platform criteria applicable at the time, which may include coverage-comparison requirements, premium requirements, geographic eligibility, licensing status, completeness, timing, or other conditions.
“User” means any Consumer, Agent, Campaign Sponsor, vendor, administrator, or other person who accesses or uses the Platform.
3. ELIGIBILITY AND AUTHORITY
You may use the Platform only if:
• You are at least 18 years old;
• You have the legal capacity to enter a binding agreement;
• You are not prohibited from using the Platform under applicable law;
• The information you provide is truthful and accurate; and
• You comply with these Terms and applicable laws.
If you act on behalf of a business or other entity, you represent and warrant that:
• The entity is validly organized where required;
• You have authority to act for and bind the entity;
• The account and business information you provide is accurate;
• You will use the Platform only for authorized business purposes; and
• You will ensure that personnel using the account comply with these Terms.
InsureIF may require identity, business, licensing, telephone, payment, or other verification before allowing access to some features.
4. WHAT INSUREIF IS
InsureIF is a technology platform designed to facilitate insurance visibility, insurance-information management, controlled insurance-data sharing, quoting opportunities, and connections between Consumers and participating licensed Agents.
The Platform may allow Consumers to:
• Create and manage an account;
• Upload, enter, import, connect, or store insurance information;
• Organize current policies, coverages, premiums, property, vehicles, drivers, household information, or related records;
• Publish a Lead for review by eligible Agents;
• Receive Quotes;
• Review estimated premium differences or savings;
• Communicate with InsureIF or participating Agents;
• Participate in Campaigns or referral programs; and
• Receive account and Quote-related notifications.
The Platform may allow Agents to:
• Create and verify an Agent account;
• Review eligible Lead information;
• Purchase or obtain authorized Lead access;
• Submit Quotes;
• Track businesses, relationships, prospects, follow-up activity, and Campaigns;
• Purchase Memberships, credits, or other Platform services;
• Create or participate in Campaigns;
• Receive referrals or attribution; and
• Use other Agent tools made available by InsureIF.
5. WHAT INSUREIF IS NOT
Unless InsureIF expressly states otherwise in writing:
• InsureIF is not an insurance company or insurance carrier;
• InsureIF does not underwrite insurance;
• InsureIF does not issue, bind, cancel, renew, or modify insurance policies;
• InsureIF does not guarantee that insurance will be available;
• InsureIF is not a party to an insurance contract between a Consumer and an insurer;
• InsureIF does not determine final insurance eligibility, pricing, coverage, underwriting, or claims outcomes;
• InsureIF does not guarantee the accuracy or completeness of information supplied by insurers, Agents, Consumers, data providers, or other third parties;
• InsureIF does not provide legal, tax, accounting, investment, or individualized insurance advice; and
• InsureIF does not guarantee that a Quote, Lead, Campaign, referral, Membership, or other Platform activity will result in a purchase, policy, commission, relationship, reward, or financial benefit.
Insurance products and insurance advice are provided by licensed third parties. Consumers are responsible for reviewing coverage, exclusions, deductibles, limits, conditions, insurer information, Agent credentials, and policy documents before making an insurance decision.
6. ACCOUNTS AND ACCOUNT SECURITY
6.1 Account Information
You agree to provide and maintain accurate, complete, and current account information.
You may not:
• Create an account using false information;
• Impersonate another person or entity;
• Create an account for someone without authorization;
• Transfer, sell, rent, or share an account without permission;
• Allow unauthorized persons to use your credentials; or
• Create multiple accounts to evade restrictions, obtain duplicate benefits, manipulate Campaigns, or abuse the Platform.
6.2 Credentials and Security
You are responsible for:
• Maintaining the confidentiality of your login credentials;
• Using reasonable security practices;
• Protecting access to your email and mobile telephone;
• Reviewing account activity;
• Promptly updating inaccurate information; and
• Immediately notifying InsureIF of suspected unauthorized access.
You are responsible for activity conducted through your account unless prohibited by law.
6.3 Verification
InsureIF may require verification of:
• Email addresses;
• Mobile telephone numbers;
• Personal identity;
• Business identity;
• Insurance licenses;
• Agency affiliation;
• Tax information;
• Payment information;
• Authority to act for another person or business; and
• Other information relevant to Platform security or eligibility.
Verification by InsureIF does not constitute an endorsement, guarantee, certification, or warranty concerning a User.
7. CONSUMER INSURANCE INFORMATION
7.1 Information Submitted by Consumers
Consumers may enter, upload, import, connect, or authorize access to insurance and related information.
By submitting information, you represent and warrant that:
• The information is accurate to the best of your knowledge;
• You are authorized to provide it;
• You are authorized to provide information concerning any household members, drivers, insured persons, properties, vehicles, employees, or other persons included in the information;
• The information does not violate another person’s rights;
• The information was not obtained unlawfully; and
• InsureIF may process the information as described in these Terms and the Privacy Policy.
7.2 Policy Documents and Automated Processing
The Platform may use document processing, optical character recognition, automated extraction, artificial intelligence, rules-based systems, or other technologies to interpret information from uploaded documents.
Automated extraction may be incomplete or inaccurate. You are responsible for reviewing extracted information and correcting material errors.
InsureIF does not guarantee that uploaded documents, extracted data, imported information, or comparisons are complete, current, or error-free.
7.3 Current Insurance Information
Consumers are responsible for keeping current policy information accurate, including:
• Premiums;
• Coverage limits;
• Deductibles;
• Policy dates;
• Vehicles;
• Properties;
• Drivers;
• Household members; and
• Other facts relevant to insurance quoting.
Inaccurate or outdated information may result in Quotes that cannot be honored or that change during underwriting.
8. LEADS AND CONTROLLED VISIBILITY
8.1 Creating and Publishing a Lead
A Consumer may choose to create or publish a Lead using insurance and account information.
Publishing a Lead authorizes InsureIF to:
• Process the information;
• Display information according to the Platform’s controlled-visibility rules;
• Make the Lead available to eligible Agents;
• Facilitate Quotes;
• Track Lead activity;
• Determine whether Platform qualification conditions have been met; and
• Provide information to an Agent when authorized under Platform rules.
8.2 Initial Visibility
A newly published Lead may initially display limited, masked, summarized, generalized, or de-identified information.
The information available to an Agent may include items such as:
• State or general location;
• Insurance type;
• Current premium;
• Coverage summary;
• Property, vehicle, or risk characteristics;
• Lead age or expiration information;
• Eligibility indicators; and
• Other information InsureIF determines appropriate for preliminary review.
8.3 Visibility Expansion
After a Lead has been published for a period of time, including approximately 24 hours in some circumstances, InsureIF may:
• Display the Lead to additional eligible Agents;
• Expand its geographic or Agent visibility;
• Modify the information available for review;
• Change purchase eligibility; or
• Apply different distribution rules.
Timing, visibility, pricing, and distribution may vary based on state, product, Lead characteristics, Platform configuration, account status, participation levels, legal requirements, and other operational factors.
8.4 Contact Information Protection
Consumer contact information is not ordinarily provided to an Agent merely because the Agent can view preliminary Lead information or purchases an initial opportunity.
Contact information may be released when applicable Platform conditions are satisfied, which may include:
• The Agent submitting a Quote through the Platform;
• The Quote satisfying applicable coverage-comparison requirements;
• The Quote improving on the Consumer’s current premium or otherwise qualifying under Platform rules;
• The Agent completing any required payment or credit transaction;
• The Consumer authorizing communication; and
• Any additional compliance, eligibility, or geographic requirements.
InsureIF may modify qualification rules when reasonably necessary to improve the Platform, comply with law, address fraud, or respond to changes in insurance markets.
8.5 Nonexclusive Leads
Unless the Platform expressly states otherwise:
• Leads are nonexclusive;
• Multiple Agents may view or obtain access to a Lead;
• Multiple Agents may submit Quotes; and
• Purchasing access does not prevent another Agent from participating.
8.6 Lead Availability
InsureIF does not guarantee:
• A minimum number of Leads;
• Lead accuracy;
• Lead responsiveness;
• Contact access;
• Consumer interest;
• Quote eligibility;
• Geographic availability;
• Exclusivity;
• Policy conversion; or
• Revenue or commissions.
9. AGENT RESPONSIBILITIES
Agents represent and warrant that they will:
• Maintain all licenses, appointments, authorizations, and qualifications required for their activities;
• Use Lead information only for authorized insurance quoting and related permitted purposes;
• Comply with insurance, privacy, telemarketing, anti-spam, consumer-protection, recordkeeping, and advertising laws;
• Provide accurate information concerning themselves, their agency, insurers, Quotes, products, and services;
• Submit Quotes in good faith;
• Compare coverage accurately and not misrepresent premium differences;
• Avoid deceptive, unfair, coercive, discriminatory, or abusive practices;
• Protect Consumer information;
• Not resell, republish, export, scrape, or distribute Lead information without authorization;
• Not use Lead information to build unrelated marketing databases;
• Honor applicable communication preferences and opt-outs;
• Maintain appropriate errors-and-omissions insurance where required or prudent;
• Avoid offering unlawful rebates, gifts, inducements, or compensation; and
• Be responsible for their communications, recommendations, representations, and insurance transactions.
InsureIF may suspend Agent access, withhold contact information, reverse transactions, require additional verification, or terminate an Agent account when InsureIF reasonably believes these obligations have been violated.
10. QUOTES AND ESTIMATED SAVINGS
10.1 Nature of Quotes
Quotes displayed through the Platform may be preliminary, conditional, estimated, or subject to:
• Underwriting;
• Verification of information;
• Consumer reports;
• Insurance scoring;
• Claims history;
• Property inspections;
• Vehicle or driver verification;
• Coverage selection;
• Payment-plan selection;
• Discounts;
• Fees;
• Taxes;
• Carrier approval;
• Policy effective date; and
• Other insurer requirements.
A Quote is not binding unless and until it is accepted and bound by an authorized insurer or Agent under applicable law.
10.2 Coverage Comparisons
InsureIF may compare available Quote information with current insurance information supplied to the Platform.
Automated comparisons may not identify every difference in:
• Coverage;
• Exclusions;
• Endorsements;
• Conditions;
• Deductibles;
• Limits;
• Insurer strength;
• Claims service;
• Payment terms; or
• Other policy features.
A lower premium does not necessarily mean equivalent or better coverage.
Consumers should review the complete Quote and policy terms with the Agent before changing insurance.
10.3 Estimated Savings
Estimated savings may be calculated by comparing:
• A current premium supplied to or stored in the Platform; and
• A quoted premium submitted or displayed through the Platform.
Estimated savings may be annualized, rounded, or based on assumptions.
Estimated savings are informational only and are not a guarantee. Actual premiums or savings may change because of underwriting, fees, taxes, payment plans, coverage changes, policy dates, discounts, verification, or other factors.
11. LEAD PURCHASES, CREDITS, AND FEES
11.1 Pricing
Lead prices, access fees, credit requirements, Membership charges, Campaign expenses, transaction fees, and other costs will be displayed through the Platform or otherwise communicated before the applicable transaction.
Prices and available products may vary by:
• State;
• Insurance type;
• Account type;
• Membership;
• Lead characteristics;
• Campaign;
• Volume;
• Promotion; and
• Other business or operational factors.
11.2 Lead Purchases
A Lead purchase, credit redemption, or access transaction does not guarantee:
• Consumer contact information;
• Consumer response;
• Exclusive access;
• Quote acceptance;
• A bound policy;
• Commission;
• Revenue; or
• Any other result.
Lead purchases and credit redemptions are generally final once access or value has been provided, except:
• As expressly stated in a posted refund policy;
• When InsureIF determines that a technical or processing error occurred;
• When a transaction qualifies for an expressly offered recovery or refund process; or
• When a refund is required by law.
11.3 Credits and Account Balances
Credits, promotional balances, purchasing power, account funds, or similar Platform units:
• Are not bank deposits;
• Do not earn interest;
• May be limited to specified Platform uses;
• May be nontransferable;
• May be subject to expiration or forfeiture where disclosed and legally permitted;
• May have different refundability rules based on their source; and
• Have no cash value except where expressly stated or required by law.
InsureIF may correct balance errors, reverse duplicate transactions, recover improperly issued credits, or place temporary holds when reasonably necessary to investigate fraud, disputes, payment failures, or accounting errors.
12. MEMBERSHIPS AND RECURRING BILLING
12.1 Membership Terms
Membership features, price, billing interval, included benefits, credits, limits, and renewal terms will be displayed at enrollment.
Memberships may include features such as:
• Platform access;
• Lead purchasing power;
• Campaign tools;
• Business-tracking tools;
• Reporting;
• Account support;
• Credits; or
• Other services.
Benefits may vary by plan and may be modified as permitted by these Terms and applicable law.
12.2 Automatic Renewal
When a Membership is identified as automatically renewing, you authorize InsureIF and its payment processor to charge the applicable recurring fee and taxes to your selected payment method at each billing interval until canceled.
The price and renewal interval will be disclosed before purchase.
12.3 Cancellation
You may cancel an automatically renewing Membership using the cancellation method made available through the Platform or by contacting InsureIF.
Unless otherwise disclosed or required by law:
• Cancellation stops future renewal charges;
• Access may continue through the end of the paid billing period;
• Partial-period refunds are not automatically provided; and
• Unused benefits or credits may expire according to the applicable plan terms.
12.4 Changes to Memberships
InsureIF may change Membership pricing, features, limits, or benefits by providing notice required by law.
Material pricing changes to an automatically renewing Membership will apply prospectively and will not be charged before any notice or consent required by applicable law.
13. PAYMENTS AND PAYMENT PROCESSORS
Payments may be processed by third-party payment providers such as Stripe.
By making a payment, you:
• Authorize the applicable charge;
• Represent that you are authorized to use the payment method;
• Agree to provide accurate billing information;
• Agree to applicable payment-processor terms; and
• Authorize InsureIF to receive transaction and status information.
InsureIF may retry failed recurring payments, suspend paid features, restrict purchases, recover amounts due, or cancel a Membership following a payment failure.
InsureIF is not responsible for delays, holds, declines, reversals, freezes, identity verification, or other actions independently imposed by a payment processor. This provision does not excuse InsureIF from responsibilities imposed on it by applicable law.
You are responsible for applicable taxes unless InsureIF is required to collect or remit them.
14. CONSUMER COMPENSATION, PAYOUTS, AND INCENTIVES
Where permitted by law and expressly offered through the Platform, a Consumer or participant may become eligible for compensation, account credits, incentives, referral payments, or other benefits.
Eligibility may depend on:
• State law;
• Location;
• Campaign terms;
• Insurance activity;
• Account verification;
• Transaction status;
• Minimum thresholds;
• Tax or identity information;
• Fraud review;
• Expiration periods; and
• Other disclosed requirements.
InsureIF may delay, deny, adjust, reverse, or recover a payment or benefit when reasonably necessary to:
• Comply with law;
• Correct an error;
• Prevent fraud or abuse;
• Resolve a duplicate transaction;
• Verify eligibility;
• Respond to a dispute or payment reversal; or
• Enforce Campaign or Platform terms.
No compensation, gift, rebate, reward, or incentive will be provided where prohibited by insurance or other applicable law.
15. CAMPAIGNS
15.1 Campaign Creation
Eligible Agents, vendors, employers, organizations, or other Campaign Sponsors may create or participate in Campaigns through the Platform.
Campaigns may offer:
• Rewards;
• Discounts;
• Goods;
• Services;
• Educational resources;
• Referral benefits;
• Promotional opportunities; or
• Other incentives.
15.2 Campaign Sponsor Responsibilities
A Campaign Sponsor is responsible for:
• Campaign accuracy;
• Legal compliance;
• Eligibility requirements;
• Official rules and disclosures;
• Funding;
• Inventory;
• Delivery and fulfillment;
• Applicable taxes;
• Consumer-protection compliance;
• Insurance inducement and rebating restrictions;
• Promotion and advertising laws;
• Privacy practices;
• Intellectual-property rights; and
• Resolving Campaign-related complaints.
Campaign Sponsors may not create or administer unlawful, deceptive, misleading, discriminatory, unsafe, or inadequately funded Campaigns.
15.3 InsureIF’s Role
InsureIF may provide technology that:
• Displays Campaigns;
• Tracks participation;
• Records attribution;
• Facilitates communications;
• Applies eligibility logic;
• Displays benefits; or
• Supports Campaign administration.
Unless InsureIF expressly identifies itself as the Campaign Sponsor, InsureIF is not the provider or guarantor of a third-party reward, product, service, or benefit.
15.4 Campaign Disputes
Users should initially direct fulfillment and performance disputes to the applicable Campaign Sponsor.
InsureIF may assist with records, technical issues, fraud investigation, or Platform enforcement but does not guarantee resolution or fulfillment by a third party.
Nothing in these Terms eliminates any rights or remedies that cannot legally be waived.
16. REFERRALS AND AFFILIATE PROGRAMS
InsureIF may offer referral, affiliate, attribution, or partner programs.
Participation may be subject to additional terms concerning:
• Eligibility;
• Attribution methods;
• Payment calculations;
• Qualification events;
• Duration;
• Minimum payout thresholds;
• Tax reporting;
• Reversals;
• Fraud prevention;
• Prohibited advertising methods; and
• Termination.
InsureIF may deny or reverse referral credit when activity is fraudulent, duplicated, self-referred where prohibited, improperly attributed, canceled, refunded, manipulated, or otherwise ineligible.
Unless otherwise stated, participation does not create an employment, agency, franchise, partnership, fiduciary, or joint-venture relationship.
17. SMS MESSAGING TERMS
17.1 Optional Consent
Consumers may choose to receive automated text messages from InsureIF.
SMS consent is optional and is not required to:
• Create an InsureIF account;
• Use the Platform;
• Publish a Lead;
• Receive or review insurance Quotes; or
• Purchase insurance.
A User must affirmatively opt in using the consent process provided by InsureIF. An SMS consent checkbox will not be selected automatically.
17.2 Types of Messages
By opting in, you agree to receive automated account-notification text messages from InsureIF regarding qualifying insurance Quotes and related account activity.
Messages may include:
• Notice that a qualifying Quote has been added;
• Estimated annual premium savings;
• A secure link to sign in and review the Quote;
• Telephone-number verification;
• Security or account notices;
• Consent or preference confirmations; and
• Closely related service communications described at the time of consent.
InsureIF will not use consent given for quote-notification messages as consent for unrelated third-party marketing.
17.3 Message Frequency and Charges
Message frequency varies based on account, verification, consent, and Quote activity.
Message and data rates may apply according to your wireless carrier and service plan.
InsureIF does not charge a separate fee merely to receive an SMS notification, although normal Platform fees and wireless-carrier charges may apply.
17.4 STOP and HELP
You may unsubscribe from InsureIF SMS messages at any time by replying STOP.
After a valid STOP request, InsureIF may send a one-time confirmation of the opt-out. You will not receive additional messages under that messaging program unless you opt in again, except for communications permitted by law.
Reply HELP for assistance, or contact Service@InsureIF.com.
You may also manage SMS preferences through your account where that functionality is available.
17.5 Telephone-Number Changes
You agree to maintain an accurate mobile number.
If you change, transfer, disconnect, or relinquish a mobile number, you agree to promptly update your InsureIF account.
SMS consent does not automatically transfer from one mobile number to another. InsureIF may require renewed consent and verification when a mobile number changes.
17.6 Delivery
Message delivery is subject to wireless-carrier availability, filtering, network conditions, device settings, telephone-number status, and third-party messaging services.
InsureIF does not guarantee that every message will be delivered or delivered at a particular time.
17.7 Privacy
Our collection, use, retention, and protection of mobile information and SMS consent records are described in the InsureIF Privacy Policy:

InsureIF does not sell, rent, share, or otherwise provide mobile telephone numbers, SMS opt-in data, or SMS consent information to third parties or affiliates for their marketing or promotional purposes.
18. ELECTRONIC COMMUNICATIONS
You consent to receive electronic records and communications relating to the Platform, including:
• Agreements and disclosures;
• Privacy and Terms updates;
• Account notices;
• Transaction receipts;
• Membership notices;
• Security alerts;
• Quote activity;
• Campaign information;
• Support communications; and
• Other legally permitted communications.
Electronic communications may be delivered by:
• Email;
• Platform notification;
• Account message;
• Website posting; or
• SMS when separately authorized.
You are responsible for maintaining accurate contact information.
You may withdraw consent to receive legally required records electronically by contacting InsureIF, but doing so may make it impossible to maintain your account or use certain Platform features.
19. PRIVACY
Use of personal information is governed by the InsureIF Privacy Policy:

By using the Platform, you acknowledge that personal information may be collected, processed, retained, and disclosed as described in the Privacy Policy and the disclosures presented through the Platform.
Consent to these Terms does not constitute SMS consent. SMS consent is requested separately.
20. USER CONTENT AND PLATFORM LICENSE
20.1 Your Content
You retain ownership of information, documents, images, text, communications, campaign materials, business records, and other content you submit to the Platform, subject to rights held by third parties.
20.2 License to Operate the Platform
You grant InsureIF a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, format, display, transmit, analyze, and otherwise use submitted content only as reasonably necessary to:
• Provide the Platform;
• Facilitate quoting and Lead access;
• Operate Campaigns and referrals;
• Process documents and data;
• Communicate with Users;
• Maintain security;
• Comply with law;
• Enforce these Terms; and
• Improve the Platform using aggregated or de-identified information.
This license continues for as long as reasonably necessary to provide the Platform and fulfill the purposes described in the Privacy Policy.
20.3 Responsibility for Content
You are responsible for content you submit and represent that:
• You own it or have permission to use it;
• It is accurate where accuracy is material;
• It does not infringe intellectual-property, privacy, publicity, or contractual rights;
• It is not unlawful, fraudulent, defamatory, threatening, obscene, malicious, or deceptive; and
• Its submission and use will not violate applicable law.
21. INSUREIF INTELLECTUAL PROPERTY
The Platform, including its software, design, layout, workflows, branding, logos, documentation, databases, features, processes, text, graphics, and other materials, is owned by or licensed to InsureIF and is protected by applicable intellectual-property laws.
Except as expressly authorized, you may not:
• Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Platform;
• Reverse engineer, decompile, or attempt to extract source code;
• Circumvent access controls;
• Scrape or systematically collect Platform data;
• Use automated systems to access the Platform without permission;
• Remove proprietary notices;
• Use InsureIF branding in a misleading manner; or
• Create a competing product using confidential or unauthorized Platform materials.
InsureIF grants you a limited, revocable, nonexclusive, nontransferable license to use the Platform for its intended purpose while your account remains authorized.
22. FEEDBACK
If you provide suggestions, ideas, improvements, or other feedback, you grant InsureIF the right to use that feedback without restriction or compensation.
This does not grant InsureIF ownership of your insurance information, personal information, or independently developed intellectual property.
23. THIRD-PARTY SERVICES
The Platform may integrate with or link to third-party services, including:
• Insurers;
• Insurance agencies;
• Payment processors;
• Messaging providers;
• Data providers;
• Identity and licensing services;
• Campaign Sponsors;
• Employers;
• Analytics providers; and
• Other websites or applications.
Third-party products and services are governed by their own terms and privacy practices.
InsureIF does not control third-party services and is not responsible for their independent acts, omissions, availability, content, security, or performance.
This provision does not limit any responsibility InsureIF has under applicable law for its own selection, configuration, representations, or conduct.
24. PROHIBITED CONDUCT
You may not:
• Provide false, misleading, incomplete, or fraudulent information;
• Impersonate another person or business;
• Create fake, duplicate, or unauthorized accounts;
• Manipulate Leads, Quotes, Campaigns, referrals, savings calculations, or attribution;
• Circumvent contact-access restrictions;
• Obtain or use Consumer information without authorization;
• Harass, threaten, deceive, discriminate against, or abuse another User;
• Send unlawful or unauthorized communications;
• Violate consent or opt-out instructions;
• Scrape, harvest, export, or compile Platform data without authorization;
• Resell or redistribute Lead information;
• Upload malicious code;
• Interfere with Platform operation or security;
• Probe or test systems without permission;
• Use the Platform to violate insurance, privacy, telemarketing, advertising, promotion, consumer-protection, sanctions, export-control, or other laws;
• Offer unlawful insurance rebates, inducements, or compensation;
• Abuse payments, refunds, credits, memberships, Campaigns, or rewards;
• Engage in chargeback fraud;
• Infringe intellectual-property or privacy rights;
• Use the Platform for illegal, harmful, or deceptive purposes; or
• Assist another person in prohibited conduct.
25. MONITORING AND ENFORCEMENT
InsureIF may investigate suspected violations and may:
• Request documentation;
• Restrict features;
• Withhold contact access;
• Place transactions or payouts on hold;
• Remove content;
• Reverse credits or transactions;
• Suspend or terminate accounts;
• Preserve records;
• Notify affected parties;
• Cooperate with insurers, payment processors, regulators, or law enforcement; or
• Take other reasonable protective action.
InsureIF is not obligated to monitor every User, Lead, Quote, Campaign, or communication.
Failure to enforce a provision in one instance does not waive the right to enforce it later.
26. ACCOUNT SUSPENSION AND TERMINATION
26.1 Termination by You
You may stop using the Platform or request account closure, subject to:
• Outstanding payment obligations;
• Active transactions;
• Legal retention requirements;
• Pending disputes;
• Campaign obligations;
• Account-security concerns; and
• Other obligations that survive termination.
26.2 Suspension or Termination by InsureIF
InsureIF may suspend, restrict, or terminate access when it reasonably believes:
• These Terms were violated;
• Information is false or cannot be verified;
• The account creates legal, financial, security, or reputational risk;
• Fraud, abuse, or unauthorized activity occurred;
• Payment obligations remain unpaid;
• Continued access could harm another person or the Platform;
• Suspension is required by an insurer, carrier, payment processor, messaging provider, regulator, court, or law; or
• The Platform or relevant service is discontinued.
Where practical and legally appropriate, InsureIF may provide notice and an opportunity to correct the issue.
26.3 Effect of Termination
Termination may result in loss of access to:
• Account information;
• Membership features;
• Leads;
• Quotes;
• Campaigns;
• Credits;
• Tools;
• Reports; and
• Other Platform content.
Provisions concerning payments, intellectual property, privacy, disclaimers, liability, indemnification, dispute resolution, and other provisions that logically should survive will remain effective.
27. PLATFORM CHANGES AND AVAILABILITY
InsureIF may modify, add, remove, suspend, discontinue, or restrict Platform features.
InsureIF may perform maintenance or experience outages, errors, delays, or interruptions.
Where reasonably practical, InsureIF will seek to avoid materially disrupting paid services without notice. However, InsureIF does not guarantee uninterrupted or error-free operation.
Beta, preview, experimental, or developing features may be changed or withdrawn at any time and may contain errors.
28. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
INSUREIF DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF:
• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• TITLE;
• NON-INFRINGEMENT;
• ACCURACY;
• AVAILABILITY;
• SECURITY;
• RELIABILITY;
• QUIET ENJOYMENT; AND
• RESULTS.
INSUREIF DOES NOT WARRANT THAT:
• THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE;
• INFORMATION WILL BE COMPLETE OR ACCURATE;
• A LEAD WILL RESULT IN CONTACT OR A SALE;
• A QUOTE WILL BE AVAILABLE, ACCURATE, OR BINDING;
• A CONSUMER WILL SAVE MONEY;
• A CAMPAIGN SPONSOR WILL PERFORM;
• A REWARD WILL BE FULFILLED;
• AN AGENT OR THIRD PARTY WILL COMPLY WITH LAW;
• DATA WILL NEVER BE LOST OR COMPROMISED; OR
• DEFECTS WILL BE CORRECTED IMMEDIATELY.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
29. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSUREIF AND ITS OWNERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING:
• LOST PROFITS;
• LOST REVENUE;
• LOST COMMISSIONS;
• LOST OPPORTUNITIES;
• LOST DATA;
• BUSINESS INTERRUPTION;
• POLICY OR COVERAGE LOSSES;
• CAMPAIGN FAILURE;
• UNFULFILLED REWARDS; OR
• REPUTATIONAL HARM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSUREIF’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
• THE AMOUNT YOU PAID DIRECTLY TO INSUREIF DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• ONE HUNDRED DOLLARS ($100).
The limitations in this section do not apply to liability that cannot lawfully be limited, which may include liability for fraud, willful misconduct, gross negligence, certain personal injuries, or violations of nonwaivable statutory rights.
Each limitation applies regardless of the theory of liability and even if a remedy fails of its essential purpose.
30. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless InsureIF and its owners, managers, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, judgments, penalties, costs, and reasonable attorneys’ fees arising out of or related to:
• Your violation of these Terms;
• Your unlawful or unauthorized use of the Platform;
• Information or content you submit;
• Your insurance activities, Quotes, advice, communications, or transactions;
• Your Campaigns, referrals, rewards, or fulfillment obligations;
• Your infringement of another person’s rights;
• Your violation of law;
• Your fraud, negligence, or misconduct; or
• A dispute between you and another User.
This obligation does not require a Consumer to indemnify InsureIF for InsureIF’s own unlawful conduct and applies only to the extent permitted by applicable law.
InsureIF may control the defense of an indemnified claim, and you agree to provide reasonable cooperation. InsureIF will not settle a claim in a manner that imposes a personal admission or nonmonetary obligation on you without your consent, which will not be unreasonably withheld.
31. INFORMAL DISPUTE RESOLUTION
Before filing arbitration or a lawsuit, the complaining party must provide the other party with written notice describing:
• The person or entity bringing the claim;
• Relevant account information;
• The factual basis of the dispute;
• The specific relief requested; and
• Contact information for responding.
Notices to InsureIF must be sent to:

and should include “Notice of Dispute” in the subject line.
The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice.
This informal process does not prevent either party from seeking temporary or emergency relief when necessary to prevent immediate harm, nor does it extend a legal deadline unless applicable law provides otherwise or the parties agree in writing.
32. BINDING ARBITRATION AGREEMENT
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
32.1 Agreement to Arbitrate
Except for matters excluded below, you and InsureIF agree that any dispute, claim, or controversy arising out of or relating to:
• These Terms;
• The Privacy Policy;
• The Platform;
• An account;
• A Membership;
• A payment;
• A Lead;
• A Quote;
• A Campaign;
• A referral;
• Communications;
• The relationship between you and InsureIF; or
• The interpretation, enforceability, scope, or formation of this arbitration agreement
will be resolved through individual binding arbitration rather than in court.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
32.2 Arbitration Administrator and Rules
Arbitration will be administered by the American Arbitration Association (“AAA”).
For disputes involving a Consumer using the Platform for personal, family, or household purposes, the AAA Consumer Arbitration Rules will apply.
For disputes involving an Agent, agency, business, Campaign Sponsor, vendor, or other commercial User, the applicable AAA Commercial Arbitration Rules will apply.
If the AAA is unavailable or unwilling to administer the dispute, the parties will select another mutually agreeable arbitration provider. If they cannot agree, a court with jurisdiction may appoint an administrator.
32.3 Arbitration Location and Format
The arbitration may be conducted:
• By telephone;
• By videoconference;
• Based on written submissions; or
• Through an in-person hearing.
A Consumer may select a reasonably convenient location where required by applicable AAA rules or law.
For business disputes, the arbitration will ordinarily occur in Utah County, Utah, unless the parties agree otherwise or the arbitrator determines another location is required.
32.4 Arbitration Fees
Payment of arbitration fees will be governed by applicable AAA rules and law.
InsureIF will not require a Consumer to pay fees that would make arbitration prohibitively more expensive than pursuing the claim in court.
Each party will ordinarily bear its own attorneys’ fees unless a contract, statute, rule, or arbitrator permits an award of fees.
32.5 Authority of Arbitrator
The arbitrator may award the same individual remedies that a court could award under applicable law.
The arbitrator may not award relief for or against anyone who is not a party to the arbitration, except where applicable law requires otherwise.
The arbitrator will issue a reasoned written decision when required by the applicable rules or requested by a party.
32.6 Excluded Claims
Either party may bring an eligible individual claim in small-claims court.
Either party may seek temporary, preliminary, or emergency injunctive relief from a court to prevent:
• Unauthorized system access;
• Data misuse;
• Intellectual-property infringement;
• Fraud;
• Security threats; or
• Immediate and irreparable harm.
A government agency may investigate or enforce rights within its lawful authority.
32.7 No Class or Representative Proceedings
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS.
NEITHER YOU NOR INSUREIF MAY:
• PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN A CLASS ACTION;
• BRING A PRIVATE-ATTORNEY-GENERAL OR REPRESENTATIVE CLAIM ON BEHALF OF OTHERS; OR
• COMBINE CLAIMS OF MULTIPLE USERS IN A SINGLE ARBITRATION
unless both parties agree in writing or applicable law requires otherwise.
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
32.8 Jury-Trial Waiver
IF A DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND INSUREIF WAIVE THE RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.
32.9 Arbitration Opt-Out
You may opt out of this arbitration agreement by sending written notice within 30 days after the date you first accept these Terms.
The notice must include:
• Your full name;
• Your account email address;
• A clear statement that you opt out of the arbitration agreement in the InsureIF Terms of Service; and
• The date of the notice.

Opting out of arbitration will not affect the other provisions of these Terms or your ability to use the Platform.
32.10 Changes to Arbitration Terms
If InsureIF makes a material change to this arbitration agreement, the revised provision will not automatically apply to a dispute for which the parties had actual notice before the change.
Any additional notice or renewed consent required by law will be provided.
33. GOVERNING LAW
Except to the extent governed by the Federal Arbitration Act or preempted by federal law, these Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
This choice of law does not deprive a Consumer of nonwaivable protections provided by the law of the Consumer’s state of residence.
For disputes not subject to arbitration, the parties consent to the jurisdiction of the state and federal courts located in Utah County, Utah, except where applicable law requires another forum.
34. CHANGES TO THESE TERMS
InsureIF may update these Terms to reflect changes in:
• Platform features;
• Products or pricing;
• Business operations;
• Technology;
• Service providers;
• Risk or security practices;
• Legal or regulatory requirements; or
• Other legitimate operational needs.
When the Terms are updated, InsureIF will revise the “Last Updated” date.
For material changes, InsureIF may provide notice through the Platform, by email, or through another reasonable method.
Where applicable law requires affirmative consent, InsureIF will request it. Continued use alone will not substitute for consent where the law requires a separate agreement.
35. GENERAL PROVISIONS
35.1 Entire Agreement
These Terms, the Privacy Policy, and any applicable transaction-specific or program-specific terms constitute the entire agreement between you and InsureIF concerning the Platform.
35.2 Order of Priority
If additional written terms expressly conflict with these Terms, the additional terms control only for the specific product, transaction, Campaign, or feature they govern.
35.3 Severability
If a provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.
If the class-action waiver in the arbitration section is found unenforceable as to a particular claim or remedy, that claim or remedy may proceed in court after all arbitrable matters are resolved, unless applicable law requires a different result.
35.4 No Waiver
Failure to enforce a provision does not waive the right to enforce it later.
35.5 Assignment
You may not assign or transfer these Terms or your account without InsureIF’s written consent.
InsureIF may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the Platform, subject to applicable law.
35.6 No Third-Party Beneficiaries
Except as expressly stated, these Terms do not create rights for third-party beneficiaries.
35.7 Relationship of the Parties
These Terms do not create an employment, fiduciary, agency, partnership, franchise, or joint-venture relationship between you and InsureIF.
35.8 Headings
Section headings are for convenience only and do not control interpretation.
35.9 Electronic Agreement
Your electronic acceptance has the same effect as a handwritten signature to the extent permitted by law.
